ABPA Board of Directors Action

Dear ABPA Member,

The Board of Directors and I wish to share with you a letter that we recently delivered to the Commissioners of the Texas Commission on Environmental Quality (TCEQ) at the request of TCEQ’s Irrigator Advisory Council (IAC; John DeCell, Chair).

The IAC delivered to the Commissioners in August 2017 a petition to modify the Texas Administrative Code pertaining to Section 344.50, Backflow Prevention Methods. Most importantly, the request included that landscape irrigation be considered a health hazard. A comment period was established from December 8, 2017 through February 28, 2018.

We feel we have made a very strong statement to Texas in support of the IAC’s proposed language. In carrying out our responsibility as a 501(c)(3) non-profit organization, it is action such as this where the ABPA can, and must, be the most effective in providing education and public awareness regarding backflow prevention, and in the protection of potable water supplies. This role is prominently mentioned in our Mission Statement and in our bylaws. 

Our vigilance must be constant. Whether it is the need to strengthen the language of a state code, or attempt to prevent the weakening of backflow regulations, issues are occurring regularly and in multiple states across the country. In 2016, our strong statement was apparently effective when the Governor of Michigan vetoed a bill that would have greatly reduced the frequency of testing on backflow assemblies associated with irrigation systems. The Idaho legislature is currently discussing efforts to remove the annual testing requirement for some backflow assemblies. 

The Board is very aware of member concerns who question the value of annual membership, and whether it really makes any difference. This response to Texas, and others like it, represent the collective voice of ABPA and, with membership numbers, there is power in our Association.
